WHAT IS ENVIRONMENTAL DUE DILIGENCE?

Environmental Due Diligence is the process of investigation performed prior to engaging in a contract.  Environmental due diligence researches the current and former property uses to determine the likelihood of environmental impact from former on-site operations, and support the “Innocent Landowner’s Defense” under the Comprehensive Environmental Response, Compensation, and Liability Act, also known as CERCLA. By performing environmental due diligence on a property prior to purchase, a prospective owner can document baseline conditions of a property, and assess the potential liability or risk associated therein.  EI offers a wide array of traditional due diligence services, including Transaction Screens, Phase I Environmental Site Assessments, NEPA Surveys and Phase II Environmental Site Assessments.

WHAT IS ENGINEERING DUE DILIGENCE?

Many borrowers and lending institutions recognize that the physical condition of a building can impact future earnings and property values.  Deferred maintenance may lower values, impair leasing efforts, or result in additional damage to building systems.  Engineering assessments of commercial properties are used to identify immediate deficiencies associated with each property and building element and to quantify the cost associated with those necessary repairs.  Further, the assessment includes an estimate of capital reserves anticipated over the assessment or loan term.  The assessments are known by different names including Property Condition Assessments, Physical Needs Assessments, Structural Assessments, and others.
